Hmmm, the really simple example didn't work probably becaure there are not enough rows in the test tables for the
systemto use the index instead of doing a sequential scan.
 

For poly_contained and other functions that use npts, maybe the code can take into account that npts maybe 0 by doing
thebounding box test and proceed to more accurate tests only if npts > 0.

It appears that the issue is not rtree itself, but the rt_poly_union
and rt_poly_inter functions, which produce "polygons" that have only
bounding boxes.  Not sure whether that should be considered erroneous
or not.  The dummy polygons are evidently used as internal node keys
in the rtree.
